General Terms and Conditions
Fotobox-Berlin-Mieten.de Stand: Juni 2025
These General Terms and Conditions apply to all contracts for the rental of photo boxes by Fotobox-Berlin-Mieten.de (hereinafter “Contractor”) to consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB). Deviating terms and conditions of the client shall not apply unless the contractor expressly agrees to their validity in writing. By booking the service, at the latest upon payment of the reservation fee, the client accepts these GTC.
Scope of the contract: The scope of the contractual services is set out in the written contract and the service description. The Contractor shall be entitled to provide equivalent replacement equipment if this is necessary or expedient and does not constitute a significant reduction in performance.
Rental conditions (1) The subject of the contract is the temporary provision of the photo box(es) and accessories specified in the contract. (2) The rental period is the period specified in the contract. Early return does not reduce the rental price. (3) The client undertakes to use and secure the rental object properly. The rental object may not be operated outdoors without written consent. (4) The client shall be liable for damage, loss or theft of the rental object during the rental period - even in the event of third-party fault. He shall also bear the risk in the event of force majeure. (5) The rental items are the property of the contractor and may not be sold, pledged or sublet. (6) The equipment may not be structurally or technically modified. (7) The client is responsible for a stable power supply. Damage resulting from power failures or fluctuations shall be borne by the client. (8) The client shall ensure that the necessary permits for operation have been obtained and that statutory regulations are complied with. (9) In the event of damage, the client shall also be liable for consequential damage such as loss of rent. (10) The client undertakes to insure the risks (theft, damage, etc.) appropriately. (11) Defects in the rental object must be reported immediately. Otherwise warranty rights shall lapse. (12) The client's claim for damages is limited to the rental price.
Services (1) The client shall be responsible for guarding the rented property for the entire rental period, including during periods of use or rest. (2) He shall appoint a responsible contact person on site. (3) Set-up and operation shall be carried out in consultation with the venue management.
Cancellation / Termination (1) The client may cancel in writing up to 2 days before the start of the rental period. Thereafter, 100% of the rental price shall be charged as a cancellation fee. (2) The Contractor may terminate without notice if: - the rental object is used contrary to the contract, - there is a delay in payment, - force majeure makes performance impossible, - safety regulations are disregarded. (3) Consumers have a right of withdrawal under distance selling law (see point 11). This expires prematurely if the service has already been provided in full at the express request of the customer before the expiry of the withdrawal period.
Collection / delivery If the agreed rental period is not adhered to for reasons for which the contractor is responsible, the client may withdraw from the contract. Compensation for damages is excluded.
Return (1) The rental object must be returned complete, in good working order and clean. Otherwise the client shall bear the cleaning costs. (2) The replacement value shall be charged for defective, lost or soiled props. (3) If the return is delayed or not carried out properly, the full rental price must be paid. (4) Valuables left in the photo box are not subject to any liability on the part of the contractor.
Terms of payment (1) Invoices are due within 7 days of receipt without deduction. (2) The booking is not binding until payment has been received. If payment is not received, there is no obligation to perform. (3) The contractor may demand a deposit. (4) In the event of late payment, the Contractor may block access to online galleries and charge reminder fees and interest on arrears at a rate of 10% per annum.
Limitation of liability (1) The Contractor shall only be liable for damages in the event of intent or gross negligence. (2) No liability exists for - technical failures due to external causes, - loss of data, - missing or incorrect consent of third parties, - disruptions due to force majeure. (3) The client assumes responsibility for the use of the rental object and its results.
Copyrights and rights of use (1) The Contractor shall retain all copyrights to the images created. (2) The client shall receive a simple right of use for private, non-commercial purposes. Commercial use requires written permission. (3) The publication of raw data shall only take place by separate agreement. (4) The client is obliged to inform guests about photo shoots and online galleries and, if necessary, to obtain consent. (5) Online galleries shall be made available for at least 2 weeks, after which they may be deleted. (6) Upon request, premature deletion of individual images can be requested by e-mail.
Right of withdrawal (for consumers) (1) Consumers have the right to withdraw from the contract within 14 days without giving any reason. 2) The revocation period is 14 days from the conclusion of the contract. (3) The revocation is to be addressed to: David Wagner, Fotobox-Berlin-Mieten.de, Gärtnerstraße 9, 13055 Berlin or by e-mail to kontakt@fotobox-berlin-mieten.de (4) Services already rendered prior to revocation shall be remunerated in full. (5) The right of revocation shall expire if the service has been provided in full before the deadline and the client has expressly consented to this.
Data protection (1) Personal data is stored for contract processing and is not passed on to third parties. (2) Details on data processing can be found in the privacy policy.
Final provisions (1) German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. (2) The place of jurisdiction is Berlin, provided the client is a merchant. (3) Amendments must be made in writing. This also applies to the revocation of this clause. (4) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
